[ARCHIVED] Personal Statement from Attorney Jay Dees - April 28, 2020

PERSONAL STATEMENT
JAY DEES, ROWAN COUTY ATTORNEY
APRIL 28, 2020
RE: HOBBY LOBBY

Hobby Lobby can legally open based on the NC Governor’s Executive Order if they maintain all the requirements set forth by the State. Rowan County Commissioners have not adopted a local ordinance prohibiting any business from being open. My email to Hobby Lobby’s General Counsel has been misconstrued by the public. This misunderstanding is based on the fact that Hobby Lobby requested the County approve their opening. My email merely restated the State Department of Revenue’s determination that Hobby Lobby is not an essential business, but that it, like any other business, may operate if they follow current separation standards. The County has not approved, or denied any business opening because we do not have that legal authority. The Rowan County Sheriff’s Department is responsible for enforcing the Governor’s Executive Orders in the County. To the extent anyone disagrees with the State’s determination regarding Hobby Lobby, those complaints should be directed to Governor Roy Coopers Administration.
